Definitions:Â
"Me" or "I" refers to Taylor Cutler as owner and representative of Treich Design.
"You" means the person, persons, entity, or entities who are obtaining services from Treich Design.
"Private Event" or "Private Party" means an event hosted by You.
"Class" refers to an event hosted by Treich Design and open to the public.
Cancellations: Private Event bookings may be canceled or rescheduled up to 48 hours before the event with no penalty. You agree to a $40 cancellation fee for any Private Event bookings canceled after the 48-hour deadline.
Class spot bookings for classes hosted by Treich Design may be cancelled up to 48 hours before the event with a refund. No refunds will be given for cancellations after 48 hours.
(For Private Event bookings only) You agree to provide a location for your event as well as tables and chairs to fit all painters and table cloths and drop cloths as needed to protect the tables and the floor. You will also provide a water source. Let me know ahead of time if you need help with any of these things.
(For Private Event bookings only) You agree to have two adults (not including Me, the instructor) present at your Private Event at all times.
(For Private Event bookings only) Before your event, you will tell your guests that the paint we will be using is not washable.
You agree to the pricing listed on this website or my booking website UNLESS we agreed in writing to different pricing. Then you agree to that pricing. For Private Events, You agree to pay for every painter who uses a canvas at Your Private Event.
You understand that the paint Treich Design provides is not washable. You agree that Treich Design is not responsible or liable for any paint stains whatsoever. You will indemnify Me from any paint stains on your guests or their property.
You acknowledge that everyone's painting will look different. My demonstration painting will look different than the reference painting I brought. My demonstration and reference paintings may look different from any painting you saw on this site. Your painting will look different from my demonstration painting and reference painting.
You agree that I can ask painters to leave or end a paint party early (without issuing any refund) if I feel (in my sole, reasonable discretion) that any painter is being disrespectful or a danger to me, to my materials, or to other painters.
You agree that I am not responsible for any harm, tort, or claim that happens to occur at or arise from a paint party. This includes any harm, tort, or claim, but just for fun, here are some examples: exposure to chemicals in acrylic paint (I use basic acrylic paint from US art supply stores. I'm not worried about them harming anyone, this is just legal stuff); someone tripping over an easel and falling; someone getting paint in their eye, mouth, etc.; someone slipping on wet paint; someone getting stabbed by a paintbrush by a fellow jealous painter; someone getting shocked by a hairdryer while drying their painting; and so on. I am not liable for anything other than the things I can't legally absolve myself of liability for.
